The terms and conditions set out under this Privacy Policy shall govern your access to the usage of tml-asia.com.cn  (hereinafter “Portal”). 

You acknowledge that TML Educare PLT (“TML” ) reserves the right to revise this Privacy Policy at any time. The latest version of the Privacy Policy shall be updated at the Portal. The latest version of the Privacy Policy shall be binding and shall supersede any earlier version of the Privacy Policy. 

TML hereby declares that by using the Portal, you agree that your personal data may be collected and that you hereby expressly give your consent to TML to collect and process your personal data as described in this Privacy Policy. 

If you do not agree and accept the terms & conditions of this Privacy Policy and do not consent to the processing of your personal data, please discontinue your use of the Portal immediately and issue a notification to the Privacy Officer to admin@tml-asia.com

DEFINITIONS 
“Content” means all available content on the Portal. 
“TML Educare PLT” means a company incorporated under the laws of Malaysiaand having its place of business at One Stop Midlands Part Centre,  488B-04-14, Jalan Burma, 10350, Penang, Malaysia, and reference to TML may include its subsidiaries, affiliates and parent companies. TML Educare PLT and its subsidiaries and/or affiliates are hereinafter collectively known as ”TML”, “we”, “us” or “our”. 
“Services” means the services offered on the Portal. 
“You/Your” refers to you, the end user accessing the Portal. 
 
PROCESSING OF PERSONAL DATA 

Personal data that are subject to being processed include but not limited to the following: 

  • Name (first & last) 
  • Address 
  • Phone 
  • E-mail 
  • Payment details 
  • Name of the domain and host from which you are accessing the Portal 
  • IP address of the computer you are using 
  • Date and time you access the Portal; and 
  • Internet protocol (IP) address of the site from which you linked directly to the Portal 
 
HOW YOUR DATAS ARE BEING PROCESSED BY OUR PORTAL 

Your personal data is processed in order to: 

  • ascertain and verify business contact information; 
  • facilitate the transmission of notices and communications; 
  • provide future services and support; 
  • better tailor the Services to your specific needs;

TML does not collect/process/disclose your personal data for a purpose other than for which it was disclosed by you at the time of collection. 

Save as expressly provided above, TML shall share/disclose your information with/to unrelated third parties only when required to do so by applicable laws or at the request of regulatory authorities. TML will not retain your personal data longer than necessary and will ensure that reasonable steps are taken to ensure that the said personal data is destroyed or permanently deleted in the event it is no longer required. 

Should TML undergo a corporate exercise such as a merger, acquisition, or sale of its assets or part thereof, your personal data may form the part of the assets transferred/acquired. In such event, dealings with your personal data will continue to be in compliance with the provisions of the Personal Data Protection law of the country.

TML takes no responsibility for and will not be liable for the Student’s or ex-Student’s interpretation and/or misuse of materials.

Refund Policy

Welcome to the TML Educare PLT (TML) website (“the Site”), which is owned and operated by TML Educare PLT Malaysia.

These terms and conditions are important. Please read them carefully. Terms and conditions are subject to change. Since you are bound by these Terms of Use, you should periodically refer to this web document to monitor changes.

Upon enrolling in a course with TML, you (“the Student”) are entering a legal agreement under common law, in which you agree to abide by the conditions of enrollment (including meeting stated payments), in exchange for the service offered by TML during the course enrollment. The terms and conditions are subject to the jurisdiction to the laws of Malaysia.
These Terms and Conditions form the agreement between TML and the Student.  It is the Student’s responsibility to fully read, understand and agree to all Terms & Conditions, Privacy Statement and Fees & Charges upon enrollment or entering into the service agreement.  By agreeing to these Terms and Conditions and the Privacy Statement, the Student confirms they possess a full understanding of all Terms & Conditions, and willingly accepts all such terms.

Cancellation Policy
Students wishing to cancel their enrollment or service agreement must submit notification of withdrawal in writing within 14 days of the confirmation of enrollment or service agreement. In order to apply for a cancellation, the Student must complete the Change Form which the Student can obtain by writing to the following email admin@tml-asia.com . 
It is recommended students contact TML within 24 hours of submitting a cancellation request to confirm receipt. TML accepts no responsibility for and will not be liable for non-receipt of messages or transmissions. 

Payment
Payment for all purchase orders must be received in full before the start date of the course. Participants registering with a group purchase order should follow up with their employer to ensure timely payment.


Refund Policy
Your completed form acts as confirmation of acceptance, and commitment to, paying all fees as stated on the form. Form submitted electronically require a confirmation that the student has read and agreed to these Terms and Conditions, the Privacy Policy, and the Fees & Charges documentation online in order to submit and process the form. This action provides confirmation in lieu of a signature. In checking the appropriate box, the Student fully accepts TML ‘s Terms and Conditions. Students are considered to have commenced their agreement from the date of the submission.


Refunds may be granted in the event an application is submitted within 14 days of confirmation of enrollment or service agreement. The refunded cost will be less MYR300 Administration Fee per request, other prorated cost and postage if applicable. If course notes have already been sent to the student, they must be returned before the refund can be processed. Failure to return course materials in a timely manner will result in the cancellation of all refund processes. In the event an assignment has already been submitted and returned, a refund will not be issued.

If you would like to request a refund, please complete the Change Form which the Student can obtain by writing to the following email admin@tml-asia.com . Refunds will be issued via the original method of payment. 

Deferments and Extensions
Deferments and/or extensions may be granted at the discretion of TML and in adhering to the terms and conditions set by respective Partner Schools. Application for a deferment or extension must be submitted via the Change Form which the Student can obtain by writing to the following email admin@tml-asia.com. TML reserves the right to refuse a deferment or extension request in the event that:
•           Valid reason, with appropriate documentation, is not submitted
•           The Student has requested multiple deferments and/or extensions
•           The Student is not in good financial standing with TML.
If TML approves a deferment or extension, recommencement fees of RM300 may apply.

Course Transfer
For a period of 30 days following receipt of the material, the Student may apply for special consideration to transfer from one course to another. Applications must be made in writing via the Change Form which the Student can obtain by writing to the following email admin@tml-asia.com. A transfer fee of MYR300 will apply. TML will apply credit for monies paid for the original application against the new module. No refund will be issued for any difference in the course price. In the event TML grants a transfer request, confirmation in writing will be given. Course materials must be returned to the school within 10 working days for the transfer to be valid. Failure to return materials in a timely manner will cancel the transfer process. In the event an assignment has been submitted and returned a module transfer will not be granted.
